Terms of Use
These Terms of Use ("Terms") are an agreement between you and iQlear LLC ("iQlear", "we", "us"), which operates MediqRounds (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What MediqRounds is
MediqRounds is an educational platform that helps medical trainees practice presenting clinical cases on rounds. It evaluates how you communicate a case, including structure, clarity, reasoning, and delivery, using fictional, simulated cases and AI-generated feedback.
2. Not medical advice
The Service is for education only. It does not provide medical advice, diagnosis, or treatment, and it does not tell you how to manage any real patient. Cases are simulated and may be simplified. Nothing in the Service replaces your clinical judgment, your supervisors, your institution's protocols, or current clinical guidelines. Do not use the Service to make decisions about patient care.
3. AI-generated feedback
Feedback and scores are generated automatically by artificial intelligence and may be incomplete, inconsistent, or wrong. Scores are practice indicators. They are not an assessment of your clinical competence, and they are not a credential or an evaluation by any training program.
4. No real patient information
You agree not to record, type, or upload any information about real patients, including names, dates, record numbers, images, or any other detail that could identify a person. You are responsible for following your institution's privacy rules and any applicable law, including HIPAA.
5. Eligibility and your account
- You must be at least 18 years old and a student, trainee, or professional in a health field, or otherwise using the Service for education.
- You sign in with your Google account. Keep that account secure, and tell us promptly if you believe someone has used your MediqRounds account without permission.
- You are responsible for the activity on your account.
6. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to violate anyone's rights;
- try to get around usage limits, access controls, or security measures;
- access the Service through automated means, or overload, probe, or interfere with it;
- copy, resell, or redistribute the cases, feedback, or other content of the Service except for your own personal study;
- reverse engineer the Service, or use it to build a competing product;
- share your account with others.
7. Free cases, paid access, and refunds
Free cases
The first 2 Internal Medicine cases and the first Pediatrics case are free, so you can try the Service before you buy.
Paid access
- A paid plan gives you access to the cases of one pack (Internal Medicine or Pediatrics) for a fixed period (for example, 3 or 6 months). Each pack is bought separately. The plan, its pack, its length, and its price in US dollars are shown before you pay.
- Plans are a one-time payment. They do not renew automatically. Your access to the paid cases ends when the period ends, and your account and progress remain. If you buy another plan while one is active, the new period starts when the current one ends.
- Sales tax may be added at checkout where it applies.
- Payments are processed by Stripe. iQlear does not receive or store your card number.
- Each case allows a limited number of Practice and Official attempts, shown in the Service, and there are daily limits to prevent abuse. A plan gives you access to the cases, not unlimited attempts.
Refunds
You can ask for a full refund within 7 days of purchase if you have used no more than 1 of the paid cases. Write to [email protected] from the email address of your account. Refunds go to the original payment method, and paid access ends when the refund is made. Outside these conditions, payments are not refundable, except where the law requires otherwise.
If we permanently discontinue the Service while you have paid access, we will refund the unused part of your plan.
If you believe a charge is wrong, please contact us before disputing it with your bank, so we can fix it quickly.
Access codes
We may give access codes that unlock the paid cases for a limited time. A code is for the person it was given to. It cannot be sold or transferred, has no cash value, and may expire. We may cancel a code that was obtained or used improperly.
8. Ownership
iQlear owns the Service, including its software, cases, frameworks (such as R.O.U.N.D.S.), design, and content. We give you a personal, non-transferable, revocable license to use the Service for your own education while you follow these Terms. You keep ownership of your presentations. You give iQlear permission to process them to provide the Service to you, as described in our Privacy Policy.
9. Beta, changes, and availability
MediqRounds is in beta. Cases, features, feedback, and the way scores are calculated may change as we improve the Service, so scores from different dates may not be directly comparable. The Service may have errors or interruptions.
We may change, suspend, or discontinue parts of the Service. We may also update these Terms. If we make material changes, we will notify you in the Service or by email before they take effect. If you keep using the Service after that, you accept the updated Terms.
10. Ending your use
You can stop using the Service and delete your account at any time in Settings. Deleting your account also ends any paid access, without a refund for the remaining time. We may suspend or end your access if you break these Terms or if we need to in order to protect the Service or other users; in that case paid amounts are not refunded.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, iQlear disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that it will improve your performance in any exam, program, or evaluation.
12. Limitation of liability
To the fullest extent permitted by law, iQlear will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or opportunities, arising from your use of the Service. iQlear's total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.
13. Indemnity
You agree to defend and indemnify iQlear against claims arising from your misuse of the Service or your violation of these Terms, including entering real patient information.
14. Governing law and disputes
If you have a problem with the Service, please write to us first at [email protected]. We will try to resolve it with you within 30 days.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas, and you and iQlear consent to their jurisdiction.
15. General
These Terms, the Privacy Policy, and the terms shown to you when you buy a plan are the entire agreement between you and iQlear about the Service. If a court finds part of these Terms unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these Terms; iQlear may transfer them as part of a merger, acquisition, or sale of the Service. We may send you notices by email or in the Service.
If you send us suggestions or feedback about the Service, we may use them without obligation to you.
